Florida Supreme Court refuses to hear Rush Limbaugh appeal

WEST PALM BEACH -- The Florida Supreme Court said Thursday it will not consider an appeal from conservative commentator Rush Limbaugh over prosecutors' seizure of his medical records during an investigation into whether he illegally purchased painkillers. The 4-3 order did not explain the court's reasoning.

Limbaugh's attorney had argued that an appeals court misconstrued Florida law when it ruled prosecutors could obtain the records with search warrants.


Prosecuters seized Limbaugh's medical records in 2003 for an investigation into whether he illegally purchased prescription painkillers, but they have remained sealed, pending the outcome of Limbaugh's appeals. Investigators allege that Limbaugh ``doctor shopped,'' illegally visiting multiple doctors to receive duplicate prescriptions.

Limbaugh, who has not been charged with any crime, lost at the appellate court level and wanted the Florida Supreme Court to overturn a ruling that would open his medical records and possibly allow prosecutors to build a case against him.

The court said it would not consider any motions for a review of the order, so it was unclear whether Limbaugh has any further legal recourse to stop the investigation.

Mike Edmondson, a spokesman for the Palm Beach State Attorney's Office, described the case as an ``ongoing criminal investigation.'' He would not say how soon prosecutors might review the medical records, which are being held by the court, and declined further comment.

Limbaugh has maintained his innocence throughout the investigation and argues that the case threatens the privacy rights of all Floridians -- a point which has drawn the support of the American Civil Liberties Union.

Howard Simon, executive director for the Florida ACLU, said the case reaches beyond the Limbaugh investigation.

``The consequences of this ruling affect the privacy of medical records for every person in Florida,'' Simon said. ``Some of the most personal things in our lives are contained in our medical records and if they're not related to what a government agency is investigating, then it should remain nobody's business.''

Limbaugh's attorney, Roy Black, said in a statement that Limbaugh should not have to sacrifice his privacy to prove his innocence.

``He has not been charged with a crime, and he should not be charged. His medical records will show that he received legitimate medical treatment for legitimate medical reasons,'' Black said in the statement. ``Only those who have suffered the long-term agony of chronic, severe pain will understand what Mr. Limbaugh was going through and why the appropriate medical treatment for his pain was so important.''

Limbaugh acknowledged his addiction to pain medication in October 2003, blaming it on severe back pain, and took a five-week leave from his radio show to enter rehab.

He has accused Palm Beach County State Attorney Barry Krischer, a Democrat, of leading a politically motivated investigation against him and labeled it ``a fishing expedition.'' He took a break from his afternoon radio show on Thursday for a doctor's appointment and made no comment about the ruling. The show has 20 million listeners a week and is heard on nearly 600 radio stations.

Krischer's office began investigating Limbaugh in early 2003 after prosecutors met with Limbaugh's former maid, Wilma Cline. She told them she sold Limbaugh ``large quantities of hydrocodone, Oxycontin and other pharmaceutical drugs in Palm Beach County over the course of many years.''

Cline provided investigators with e-mails and answering machine recordings to support her claims and sold her story to The National Enquirer.

Prosecutors went after Limbaugh's medical records after learning that he received about 2,000 painkillers, prescribed by four doctors in six months, at a pharmacy near his Palm Beach oceanfront mansion.

They used search warrants to obtain records from doctors in Florida and California -- an action that Limbaugh argued was too invasive.

Assistant State Attorney James Martz insisted that giving Limbaugh notice of their plan to seize the records would have compromised their investigation. He said the Legislature has protected law enforcement's ability to conduct criminal investigations.

Yeah, but Rush acts like he was never addicted. Says it wasn't his fault. Says he wasn't doctor shopping. He's still holier than thou, still a blowhard, and still a biased, manipulative liar. His entire show is based on misinformation, astounding arrogance and a singular point of view.

Interesting that now that one of your own gets caught, you're interested in agreeing on this issue. I don't recall that being the case before Rush's issues came to light. The real fun here ... The real irony here ... is that Rush made a living off issues like this, but now when he's accused, it's no ones business but his and his doctors'. (plural possessive).

I actually tuned into Rush for a little while today. He was just as pompous and arrogant as ever. In half an hour, he chastised the runaway bride, verbally assaulted two public figures and made fun of someone's name. He offered nothing constructive. He was chronically egotistical. He never has opposing points of view on his show.


Now that he's run out of appeals, I'd like to see him brag his way out of criminal prosecution. And I hope they have the trials on the radio during his usual time slot.

ok rush limbaugh screwed up - i guess he has coming what ever the law that applies says he has coming ...


didja ever notice that when a conservative screws up the media is all over it , but when a liberal screws up - the media creates a vacuum to absorb any thing that may get out to the voting public .... case in point Dan Rather , but not just him , across the board ...

The media covered for Bill Clinton, too, right?

And Gary Condit?

I suppose OJ Simpson was a liberal and the media tried to bury that story, too.

The "left-wing media" theory is a crock. Most reasonable people would admit that.

The media is very objective these days, epecially since they all watchdog each other as well as the people they report on. If the media were conservative, we'd hear nothing but good news about Iraq and the economy. If the media were really liberal, we'd have a laugh track during the President's press conferences. I think they're right about where they need to be. Now if we only had an independent media, without the political affiliations or corpora6te agendas, then we'd have some real fun.


I think the reason I'll enjoy Limbaugh getting spanked so much is that Rush made a living wagging his finger at phantom 'liberal' enemies. He portrays himself not only as highly moral and patriotic, but infallible. He actually thinks he's perfect in every way. He spreads disinformation and tempers it with his sanctimonious attitude. He's a self-serving demagogue who relies not on facts, but on his imaginative spin on reality. Rush's fans (dittoheads) are an army of unobjective automotons who don't even realize they're being fleeced by the biggest liar in radio.


...And let's work on that laugh track, Bush desperately needs one...

did you not know that the dan rather thing [lie , fraud , fabrication , deliberate media backed attempt to change the course of history by swinging public sentiment to elect the wrong guy ]  was uncovered and forced to public veiw by bloggers who would not accept the lies and misrepresentation from DR himself and his parent media bosses ,  doncha remember the weeks of denials and "internal investigation"  leading up to the grudging release the whole thing was a "lie leaked by the republicans" to make "us " look bad ? ? ?   then they fired some of DRs staff ... But DR was not punished .          of course you remember . we all do .

  i cannot understand why the "tree huggers" are not all over this like flies on day old sun warmed poop .   maybe there are no tree hugging texans ?         interesting to note that the parent corp of CWM is also the parent corp of the texan waste company .....

     CWM has many names,You would think the tree huggers would be all over this one.I being a cat and a bird all in one thinks, oh yea a tree hugger too.Thinks the host money is hussssssssh money,to which ever side you are on...........I really do not like Rush
