One thing that bugs me is that it says if Sandra Day O'Connor is the deciding vote, they'll likely wait until she's gone and try the case again. What's that sh!t?
As much as I agree with the Oregon law, I'd predict that the Supreme Court is probably going to set it aside, and it might even be unanimous.
The FDA is very specific about the indications and uses for drugs, for example, even though steroids represent an incredibly important class of drugs with a myriad legitimate uses, a doctor cannot prescribe them to high school athletes for the purpose of bulking up. Any use for a drug not specifically spelled out by the FDA is proscribed, and I think this is what the Court will say.
