The owner of a water park included in more than 26 acres of downtown Niagara Falls property slated to be taken through eminent domain to expand the Seneca Niagara Casino will challenge a decision to move forward with the process, its attorney said Monday.
John Bartolomei, an attorney for Fallsite, which owns Fallsville Splash near John B. Daly Boulevard, said the firm plans to file a petition with the Appellate Division of State Supreme Court to contest a determination by Empire State Development Corp. that using eminent domain to acquire the land will not have “detrimental effects” to the environment and local residents.
Empire State Development’s directors last week authorized the agency to move forward with the eminent domain proceedings after conducting a four-month review of its impact that included a public hearing in July.
IMHO, stealing people's property is about the most evil thing you can do. Stealing a working business to give it to another nation ... that's beyond the pale.
