***Before I get started, I want to clarify that I do not condone or advocate child pornography***
When you think of the term child porn, what comes to mind? Is it a naked 6-year-old? A topless 12-year-old? Younger? Older?
I was listening to the news and they were discussing a man who was found to have child porn on his school-issued laptop computer. They wouldn't release the details of the image/s, but they were pretty sure they were illegal in nature. Most of you have probably already thought "I hope he gets life in a pound-him-in-the-ass prison, the sicko!"
Now what if I told you the 'man' was barely 18.
Now what if I told you that the picture was of his 17-year-old girlfriend, and that she took and e-mailed him the picture all on her own?
Is it still child porn?
The state doesn't clarify what exactly construes a minor in a pornographic image. The official wording is "any minor in a sexually explicit situation." That's pretty vague. Who's to say what someone finds sexually explicit?
In fact, I'll bet most people reading this thread are in possession of child porn. What about the 99% of parents that have nude photos of their kids at the tender age of 2 and under. I know there's pictures of me in the kitchen sink, getting my first bath. What about the ads that show babies' bare butts sitting in a row, which I saw in Reader's Digest? Remember when Superman stepped out of the spaceship, crawling out of the blast crater, with his super pee-pee swinging in front of John & Martha Clark? What was the rating on that flick?
Suppose that your 17-year-old girlfriend sent you a topless photo when you were 17. Then you got married to her, bought a house, raised two kids, got a dog, etc. years later, someone finds the pic of your wife. Are you now in possession of child pornography? What if was your 17-year-old son?
All I'm asking is where does the delineation lie? Is it child porn if it's a peer? Are newborns exempt for some reason? When do they become un-exempt? There need to be more specific guidelines in place.

Child porn is just wrong, period. BUT if the email was send willingly, without prior knowledge by the 18 yr old that this was going to be in the inbox, the possible charge for child porn can be dropped if the 18 yr old had no idea it was going to be there, or that it can't be proven that he knew it was going to be there.
Most places have internet policies before anyone can use a computer. I would be willing to bet that it doesn't matter if it was his own photo it was still a no no. Under 18 is under 18 period.
