An appeals court in Albany Thursday upheld state Attorney General Eliot Spitzer's interpretation of the state's Lemon Law for new vehicles.
Spitzer said the law could be invoked by consumers if dealers failed to fix significant defects in four tries, even if a subsequent repair attempt worked. Car makers DaimlerChrysler, General Motors and Saturn had argued in court that consumers had to prove that the defect continued to exist in their vehicles at the time of a trial or Lemon Law arbitration hearing in order for them to win their cases.
